Deed of Variation to S106 Legal Agreement accompanying previously approved planning permission 24/00980/OUT, to amend the Mortgagee in Possession (MIP) so that Moat Homes Limited can charge their Affordable Housing units at Market Value Subject to Tenancy clause; to amend the enforceability clause so that occupiers of individual Dwellings, the Registered Provider and their mortgagee are also excluded from liability in respect of the non-affordable housing obligations; to amend wording for clarity, to amend the typographical error contained in the definition of Shared Ownership Lease from Lettering to Letting; and to correct the typographical error and to amend the exclusions clause., so that persons exercising voluntary or contractual rights rather than solely statutory rights are also excluded from the Affordable Housing obligations.
